About Deferred Action for Childhood Arrivals (DACA)

DACA is a policy that enables certain eligible individuals to get a grant of deferred action. Individuals who are granted DACA are able to renew their grants and are eligible for work authorization. DACA has been an invaluable resource for thousands of undocumented individuals since 2012. The program allows young immigrants brought to the US as children, or who came with families who overstayed their visas, to work legally, and obtain a series of benefits including In-State Tuition, Drivers Licenses, Social Security numbers, etc.

Eligibility for Deferred Action for Childhood Arrivals (DACA)

Eligibility for DACA according to the USCIS:

You were under the age of 31 as of June 15, 2012.
Entered the United States before reaching your 16th birthday.
Have continuously resided in the United States since June 15, 2007, up to now.
Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS.
Had no lawful status on June 15, 2012.
Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces; and
Have not been convicted of certain criminal offenses.

The USCIS is no longer processing or approving first-time applications.

When Do You Need To Apply For DACA Renewal?

If you are a DACA recipient, you can apply for a renewal every two years. It is recommended to file for renewal five months before your EAD expires to ensure your renewal application is processed before your current EAD expires:

You must meet the first DACA guidelines in 2012
You must demonstrate that you did not leave the United States on or after August 15, 2012, without advance parole. *
You must have lived in the United States continuously since your most recent DACA application was granted.
You must have never been convicted of a crime, a significant misdemeanor, or three or more misdemeanors, and do not represent a threat to national security or public safety in any other way.

*If you need to travel for school, work, or humanitarian reasons, DACA recipients can apply for international travel permission known as “Advance Parole.” You should consult an immigration attorney to consider potential concerns.
